DonnaJobs is a #SmartWorking platform offering High Quality. Women Freelance Services

DonnaJobs’ platform has the goal of making possible the professional work of women who for family reasons or commitments related to the status of women cannot work or look for work.

DonnaJobs is a virtual community of female freelancers, a marketplace that offers to registered users a series of tools and services with which to seek or propose the creation of works of a creative nature.

Anyone can sign up and use the tools of the platform to search and/or promote the creation of works, but DonnaJobs is different from all other platforms because it is aimed at female freelancers only to help women against sexual discrimination, gender salary gap and at last but not least to help and support mothers during their motherhood.

We welcome applications from all suitably qualified persons regardless of their race, sex, disability, religion/belief, sexual orientation or age. However, DonnaJobs is intended as a platform to enforce women employment through positive action. We want to help women to be more represented in the workforce and we found that due to the social burden that society puts to women - whether this is due to the presence of young children or due to cultural norms – they often are invisible, do not apply for jobs, refrain from soliciting for a position. As a result, women are still under-represented in the global workforce.

Every freelancer woman can offer their services though our platform, we will take care of visibility and offer their competencies and availability to the market. Employers can choose to hire a freelancer, on the basis of merit and their ability to carry out the job: if they want to hire through DonnaJobs, they will also hire a capable woman.

4. Services

Services are offered on DonnaJobs through either DJService(s), which are fixed-price services offered by DJFree; or DJProject(s), which can be fixed price or price per hour.

Services delivered in these ways on DonnaJobs are collectively referred to in these terms as “Jobs”.

Whether or not a Job is offered and/or accepted is entirely at the discretion of the DJFree/DJBuyer. Services are provided by DJFree(s) directly to DJBuyer(s), who determine the deliverables, price and all other requirements.

DonnaJobs has no control over this process. The DonnaJobs Platform is used only as a means of providing the service and has no authority in setting prices, terms and conditions of services, authorizing payments.

IMPORTANT: On commencement of a Job and before DJFree starts working on the DJProject, the DJBuyer MUST deposit funds into the Escrow Account of the DJFree. It is highly discouraged that the DJFree start working on the DJProject without the funds being deposit into her Escrow Account by the DJBuyer. DonnaJobs declines any responsibility and will not accept any dispute in case the DJFree starts working on the DJProject before receiving the agreed sum or part of it in her Escrow Account, as expressly stated and documented in the DJBid and/or DJProgress.

The DJFree must provide regular progress updates and respond within one (1) working day to all messages from the DJBuyer in the DJProgress.

DJFree must deliver work within the delivery times either defined in her DJService or agreed with the DJBuyer upfront in the DJProgress for DJProject. DJFree’s rankings will be penalised for late delivery.

DJFree must fulfill her Jobs and DJBuyer agrees to pay for work delivered. Users will be penalised for cancellations or refunds caused by them, without just reason.

DJFree must provide, and be given the opportunity by the DJBuyer to provide, at least another iteration on the work delivered at the same condition of the previously if the DJBuyer is not initially satisfied.

Once the Job has been completed or a milestone is reached, the DJFree will send via DJProgress her invoice and when the Job is been delivered the DJFree will raise a Request for Release of Funds (RRF) held in the Escrow Account.

DJFree must not request the release of the funds before work has been completed or unless expressly stated in the DJBid or DJProgress and accepted by DJBuyer.

DJBuyer(s) must release the found within the 7 days from the delivery of the DJProject or DJService.

Please read Job Delivery Guidelines for further details.

5. Funds & Payments

Payments are made as described in section “4. Services”, for a DJProject or a DJService agreed by the DJBuyer.

The DJFree must not Request for Release of Funds from the Escrow Account prior to Job completion or a milestone reached; the purpose of funds being held in the Escrow Account is to provide the DJFree with the security needed for her to undertake the work. DJBuyer(s) must report such cases immediately. In such cases, the DJFree’s account may be temporarily or permanently suspended.

All payments between DJBuyer and DJFree must be processed through DonnaJobs both for work sourced on DonnaJobs and for any follow-on work between the DJBuyer and DJFree, either for the same DJProject or DJService or another Job. A DJFree may seek express written permission from DonnaJobs to allow payment by alternative means for a specific payment if the DJFree intends to issue proceedings or pursue legal action against the DJBuyer.

Payment (or attempt of) outside of DonnaJobs is a breach of these Terms&Conditions unless the prior express written permission of DonnaJobs has been obtained. Such payment (or attempt of) will lead to temporary and or permanent suspension of the DJBuyer and or DJFree account. The DJFree will be accountable for any loss of business and legal expenses that DonnaJobs may incur in recovering it. DonnaJobs reserve the right to sanction funds held in the DJFree's Account in order to recover lost fees. Moreover, DonnaJobs will not mediate any Disputes or be accountable to either the DJBuyer or DJFree's loss of business as a result of a violation of this clause.

Users must report straight away to DonnaJobs any attempts or offers to make payment outside of DonnaJobs by their DJBuyer or DJFree.

5.1 Deposit in DJPot

Deposit money by DJBuyer in his/her DJPot is routinely checked by DonnaJobs for fraud prevention purposes before any escrow payments are made to the DJFree.

DonnaJobs aim to process these credit funds to the DJBuyer’s User Account within ten (10) working days provided that no issues arise with Stripe handling of the payment to you. Please consult https://stripe.com/docs/payouts to check the applicable policies. In case an issue arises the payment time will vary on a per case basis. In no case, DonnaJobs accepts responsibilities for any delay or mishandling due to Stripe.

5.2 Withdraw from DJPot

To withdraw funds from her DJPot a DJFree needs to request a withdrawal on an authorized and verified Stripe Account.

DonnaJobs process withdraws request raised from 1st to 15th day at the end of each solar month and will send the money to the DJFree via Stripe Connected Account. Any withdrawal request raised from 16th to 31st day of the month will be processed at the end of the next solar month.

Your first withdrawal of funds earned may be delayed for up to fifteen (15) days for security and fraud purposes.

Subsequent withdrawals may be delayed for up to fifteen (15) days where our fraud prevention policies require a delay.

For security reasons, DonnaJobs reserves the right to request additional information from DJBuyer(s) and DJFree(s), including original documents, and to verify documents with issuing institutions. Therefore, we reserve the right to request the following proofs of identity:

  • a copy of a Government-issued ID (Passport, Driver's License or National ID Card);
  • a copy of a recent utility bill showing your name and address (less than 3 months old);

Please, take into account that Stripe could decline transactions deemed insecure by their platform and you understand and accept that we cannot take responsibility in that occurrence and you will have to contact your Bank/Card Issuer. For further reference, please consult:  https://stripe.com/docs/declines

5.3 Your Balance Account

You may have a positive balance in your DJPot if you have prepaid for fees or charges or for services to be provided to you via the Website. If you are a DJFree, you may have positive balance if you have successfully completed a DJProject, or sold a DJService, and funds have been released to you.

There are also circumstances where funds may have been credited to your DJPot in relation to an affiliate program or a referral program.

In using the Escrow Account DonnaJobs act, subject to these Terms&Conditions, on the User's behalf.

The funds in your Account are not held separately by DonnaJobs and may be commingled with our general operating funds, and/or funds of other User's Accounts.

DonnaJobs IS NOT A BANK and only holds funds for the purposes of settling the provision of services for DJFree(s).

WE STRONGLY RECOMMEND THAT ALL USERS DO NOT HOLD BALANCES ON THE PLATFORM. FUNDS HELD BY DONNAJOBS ON THE PLATFORM ARE NOT INSURED NOR COVERED BY ANY FINANCIAL SERVICES COMPENSATION SCHEME OR ANY OTHER GOVERNMENT AGENCY. USERS WILL NOT RECEIVE INTEREST OR OTHER EARNINGS ON THE FUNDS IN THEIR ESCROW ACCOUNT OR DONNAJOBS USER ACCOUNT.

DonnaJobs will endeavor to ensure that the funds in the Escrow Account or DonnaJobs User Account are available to the User in accordance with these Terms&Conditions but do not guarantee that they will be available to the User in circumstances which are unforeseen or beyond her control.

If DonnaJobs has to return funds to the DJBuyer due to the DJBuyer (contrary to these Terms&Conditions) filing a dispute or requesting a payment be reversed through its bank or Stripe Account then DonnaJobs will be entitled to recover any such amount from the DJFree’s Account (and if insufficient monies are in the DJFree’s Account), credit card or other previously made payment method if available.

If DonnaJobs is unable to recover the amount returned to the DJBuyer from the DJFree in full then the DJFree agrees to pay to DonnaJobs any outstanding sums within 48 hours of DonnaJobs making a request.

To prevent funds being held indefinitely in the Escrow Account, DonnaJobs will notify the DJFree in the event of funds being held in an Escrow Account for a Job that i) does not have an unpaid Request for Release Funds nor an open Dispute; and ii) has not had any activity in the DJProgress for a period of one (1) calendar month or longer.

Activity is defined as any action by the DJBuyer or DJFree in the DJProgress such as a message posted, a Request for Release Funds raised, a deposit into the Escrow Account made or a Refund Request raised.

  1. The DJFree will be asked to confirm either i) that the Job is still in progress by posting a message to the DJBuyer in the DJProgress with an update on progress; ii) that the Job has been completed by raising a Request for Release Funds in accordance with the terms defined in section 4. Services; or iii) that the Job was canceled and issuing the DJBuyer with a refund in accordance with the terms in Section “6. Cancellations and Refunds”.
  2. If no action is taken by the DJFree within seven (7) days it will be assumed that the Job was not delivered by the DJFree and the funds held in the Escrow Account will be automatically refunded back to the DJBuyer's Account. In this event, the DJFree's rankings will be affected in accordance with the terms in Section “6. Cancellations and Refunds”.

DonnaJobs uses third-party service providers including Stripe to process payments by DJBuyer(s) and to transfer funds to DJFree(s). These third-party payment service providers are regulated and authorised to provide payment services in the countries where they operate. DonnaJobs may share your personal or transactional information with third-party payment service providers when it is necessary to process payments.

6. Cancellations & Refunds

6.1 Cancellation of a Job

After the commencement of a DJProject, the DJBuyer or DJFree may request a cancellation:

  1. the requestor must notify the other party of the cancellation by placing a message in the DJProgress. Alternatively, if there are funds in the Escrow Account and the DJBuyer believes they are entitled to a refund subject to Section “6.2 Job Refund Policy”, the DJBuyer can notify the DJFree of the cancellation by requesting a refund using the “Request Refund” message in the DJProgress.
  2. if the DJBuyer fails to notify the DJFree in the DJProgress that they wish to cancel the Job and the Job is subsequently completed, the DJBuyer must pay for the service delivered in accordance with these Terms&Conditions and should not seek to file a dispute or reverse payment with their credit card provider, bank or Stripe Account or any other mean.

Once notified of a cancellation:

  1. the DJFree should stop working on the Job immediately;
  2. the parties should agree in the DJProgress what payment is necessary for any work completed (or time spent, if it is a per hour DJProject). If the cause of the cancellation was not due to the circumstances defined in “6.2 Job Refund Policy” the DJFree is entitled to request payment at minimum equal to the value of the deposit funds held in the Escrow Account. The DJFree should request payment in accordance with “4. Services” of these terms.

Before the commencement of a DJProject the DJBuyer may request a cancellation:

  1. if the DJProject as 0 proposals (DJBid);
  2. if the DJProject as at least 1 proposal (DJBid) the DJBuyer cannot request a cancellation;
  3. any additional listing feature is not refundable.

DJFree may request a cancellation of a DJService:

  1. if it was never sold;
  2. any additional listing feature is not refundable.

If DJFree requests cancellation of a DJService already sold:

  1. the DJFree must notify the other party of the cancellation by placing a message in the DJProgress. DJBuyer can Request a Refund of the Funds in the Escrow Account using the “Request Refund” message on the DJProgress.

DJBuyer may request a cancellation of a DJService bought and they must notify the other party of the cancellation by placing a message in the DJProgress:

Once notified of a cancellation:

  1. the DJFree should stop working on the Job immediately;
  2. the parties should agree in the DJProgress what payment is necessary for any work completed. The DJFree should request payment in accordance with “4. Services” of this Terms&Conditions.

6.2 Job Refund Policy

A DJBuyer is entitled to receive a refund of funds held in the Escrow Account under the following circumstances:

  1. no response: the DJFree has not responded in the DJProgress within one (1) working day of the commencement of the Job;
  2. non-delivery:
    1. for DJService(s), the DJFree of a DJService did not deliver the scope of work within the delivery timescales indicated in the DJService.
    2. for fixed price DJProject(s), non-delivery means agreed scope of work was not delivered within the agreed timescales;
    3. for per hour rate DJProject(s) no time has been spent.
  3. poor quality: with the exception of per hour rate DJProject, the deliverables provided by the DJFree do not meet the terms defined in “4. Services” after at least another revision has been provided by the DJFree in response to detailed feedback from the DJBuyer; or
  4. the DJFree lost a Dispute.

DJBuyer and DJFree may mutually agree to a refund for reasons other than the previous clause, however, authorization of such refunds will be subject to a review by DonnaJobs, as defined in Section “6.3 Requesting a Refund”.

Refunds are only applicable to funds held in the Escrow Account. As in “4. Services” funds should only be paid out of the Escrow Account once the DJBuyer is satisfied that the Job (or any agreed milestone deliverables) has been completed.

By releasing funds from the Escrow Account, the DJBuyer accepts that this money is non-refundable.

DJBuyer must avoid filing a dispute or reversing a payment through their credit card holder, Bank or Stripe Account. Attempts to seek a refund in this way will lead to the DJBuyer's account being automatically suspended.

6.3 Requesting a Refund

A DJBuyer can request a refund of the funds held in the Escrow Account using the “Request Refund” message in the DJProgress and specifying a reason for their request:

  1. the DJFree must either approve or reject the Refund Request by posting her answer in the DJProgress. Rejected Refund Requests are raised manually to DonnaJobs for Dispute assistance and handled in accordance with Section “7. Disputes”;
  2. if the DJFree does not respond to a Refund Request within three (3) working days (a “non-actioned” Refund Request) then DonnaJobs may release the funds automatically back to the DJBuyer subject to the following clause.

DonnaJobs will process approved (or non-actioned) refund requests back to the DJBuyer's Account subject to a review of the refund reason and circumstances to ensure that both parties have complied with these Terms&Conditions and that the purpose of the refund is not to avoid any of the parties' obligations under these Terms&Conditions.

If DonnaJobs reasonably believes that the parties have not complied with these Terms&Conditions or are seeking to avoid any such obligations DonnaJobs shall not be obliged to make a refund.

6.4 Refund and Cancellation Penalties

Users are strictly discouraged from causing Cancellations and Refunds. Refunds will impact Users standing in the DonnaJobs marketplace as follows:

  1. where the DJFree is at fault for the refund (for example, due to no response, poor quality of work or they have canceled the Job), it will negatively impact their DJFree status and rankings;
  2. where the DJBuyer is found to be the cause for the refund (for example, an early cancellation due to a change in their business need) it will negatively impact their DJBuyer status;
  3. multiple refunds attributed to a User will lead to temporary and or permanent restrictions on their account depending on the severity.

7. Disputes

DonnaJobs encourage our DJFree(s) and DJBuyer(s) to try and resolve any disagreements between themselves. However should that not be possible DonnaJobs Customer Services can provide Dispute Resolution Service.

A Dispute can be raised:

  1. by the DJFree manually after a DJBuyer has rejected a Request for Release Funds Action;
  2. by the DJFree or by the DJBuyer manually if the DJFree decides to reject a Refund Request received from a DJBuyer.

To raise a dispute, the DJFree and the DJBuyer are required to pay a non-refundable fee as per section “9. DonnaJobs Fees”.

Disputes are available to DJFree(s) that have qualified as DJTrusted Members of the DonnaJobs community.

For Request for Release Funds Action Disputes specifically, the amounts taken into consideration for the Dispute are the lower of the escrow balance.

If the amount disputed is £100/€100 or above, DonnaJobs may reach out to both parties in order to mediate and try and bring the Dispute to resolution.

DonnaJobs will aim to make a resolution decision on behalf of both parties within seven (7) days. If a mutual resolution has already been agreed between both parties on the DJProgress, then the dispute will either be canceled or resolved in line with the mutual agreement.

In the event of having to make a resolution decision, DonnaJobs will use only the communication in the DJProgress as sole evidence, and consider:

  1. if both parties are acting in good faith and have tried to resolve the issue between themselves before contacting DonnaJobs, including at least a second attempt made between both parties to complete or rectify the Job;
  2. if the Job was delivered (or the milestone was met, if the Dispute is for a milestone payment) in accordance with the terms in Section “4. Services”;
  3. for Disputes concerning the quality of the work delivered: DonnaJobs will consider whether the DJFree has met general quality standards as defined in Section “ Quality of the Job” of Job Post&Delivery Policies. Assessments on quality i) down to perceived taste, or ii) requiring specialist technical or subject matter expertise, will not form part of the resolution decision;
  4. if the DJBuyer and DJFree have complied with these Terms&Conditions.

In the event of having to make a resolution decision on behalf of the parties, DonnaJobs will notify both parties within seven (7) days of the Dispute. The disputed funds shall be dealt with in accordance with the resolution decision and these Terms&Conditions. DonnaJobs involvement with the Dispute ends once the resolution in relation to the Dispute has been communicated.

Users agree and accept that any payments and or other actions made by DonnaJobs in accordance with the resolution decision of a Dispute are made in good faith and Users shall have no cause of action against DonnaJobs (whether in contract, tort or otherwise) in respect of the resolution decision or any such actions or payments made pursuant to it. Users further agree and accept that they have no right to seek to hold DonnaJobs liable for a DJBuyer or DJFree’s alleged actions or failures.

8. Leaving Rate & Feedback

When the Job is completed and the DJFree has been paid by the DJBuyer, both parties are asked to provide both qualitative feedback and a rating from 1-5 for the other party.

This rating influences each User's ranking on DonnaJobs. A review (feedback) is published in the member profile.

Both parties should complete the feedback honestly. Users must not falsify feedback, manipulate or coerce another User by threatening negative feedback or offer incentives in exchange for feedback. Any attempts of this nature should be reported immediately to DonnaJobs.

Feedback comments that are reported to DonnaJobs as defamatory, abusive or offensive will be reviewed and may be removed at her discretion.
